ONE EVENING,BEVERLY BRABHAM'S MOTHER, ANNE BRABHAM, RECEIVED A TELEPHONE ORDER FOR THE THIRD SENTENCE (on the same case)
FROM JUDGE BURT SMITHART
Smithart called to tell Mrs. Brabham to
"give Beverly the message that he had sentenced her to probation". This male had literally ordered another sentence on the same case" (the third of multiple sentences).
For most people, the law states that a person has the right to a hearing, the right to be present, and the right to be represented when sentenced.
Beverly Brabham had None of the Above on the falsely concocted lie from the beginning.
Laws did not seem to matter in Bullock County, Alabama, when she was so railroaded by Judge Bill Robertson, D.A. Boyd Whigham, and accuser J. W. Waters, Sr. There is no justice there; it is all about Who's Who, and in Beverly's case, it was who could do who the favor in their interest (D.A. Boyd Whigham's) of self-enrichment from the accuser.
SMITHART's TELEPHONE ORDER
OF THE SENTENCE Night Court in Session on(phone)line!
Even though probation is not ordered after a person completes a probation revocation, Beverly requested one year probation in January 2001 in lieu of returning to prison. Smithart refused. However here is the order that he phoned in to her mother for one year anyway, after robbing her of the 78 days where she returned to avoid further corruption from Bullock County, Alabama.
On January 24, 2001, Smithart ruled from the bench that if Beverly Brabham was released prior to April 10, 2001, that she would be placed on 3-5 years probation. He gave her the choice to take the probation or to return to 'hell without the fire' for 78 more gruelling days. To avoid further injustice from the Bullock County system, she chose the 78 days over their probation trap.
Once the sentence for a LIE ended on April 10, 2001, (for the second time), Smithart again sentenced her, for a third time on the same conspired LIE, via a telephone call to her mother.
Beverly Brabham's plea to the Alabama Judicial Inquiry Commission for justice and relief. The Commission turned a deaf ear. The case was rife with bad faith, ill will, and malice.
Judge Gaither's Affidavits Judge Gaither wrote the second Affidavit after discovering that Judge Smithart lied about Judge Gaither's testimony in the above order
It is an ominous sign of an irretrievably broken system when the United States Federal Courts refuse to protect a citizen's guaranteed Constitutional Rights! Who else are they to be guaranteed by???
